Almost a year to the day after Bell Telephone first instigated charges against the Fifth Estate for publication of plans for an illegal “mute” box (a device for receiving free long-distance telephone calls), the Wayne County prosecutor’s office decided on August 20, that their case was still worth pursuing and hauled the current staff into court.

FE Beats Ma Bell Well, sorta

It was the re-match of the week: Michigan Bell’s high-paid legal staff working in tandem with the full weight of the Wayne County Prosecutor’s office, pitted against the Fifth Estate aided by attorney Ken Mogill. In other words--an even match.

Although a Recorder’s Court jury voted 10 to 2 last August for acquittal on the charge that the Fifth Estate published information on a telephone device that could be used to cheat Ma Bell, the phone company, assisted by their toadies in the prosecutor’s office, threatened to drag us into court a second time. Usually such a lopsided verdict in a misdemeanor case means that it would be dropped, but Bell realized that they could blackmail us through manipulation of the courts to get what was clear they couldn’t achieve in open court.

FE Criticized & Our Response

To the Fifth Estate:

The letter from “Kirk Johnson” (FE #290, March 2, 1978), which equated Fifth Estate’s practice of running a profit-making book service (to support itself) with Search & Destroy’s record company ads (for the same end), makes public a discussion that has been private too long.

That the opening of this critique—which really began with FE’s important remarks on Black Rose Books’ capitalist procedures—finally arrives via a spokesman for Search & Destroy is a sad irony. S & D is a completely uncritical promo rag which hopes to be accepted by what it sees as the latest cultural fad, punk rock. Done anonymously, it (characteristically) helped organize a recent two-day benefit for the UMW strike, this piece of liberal/ leftist reformism easily coexisting next to censored interviews and ads for rip-off night clubs.

Federico Arcos A Stalwart of the Spanish Revolution Passes

As we go to print, it is with great sadness that we report the passing of our compañero, amigo, padre, and abuelo, Federico Arcos, in Windsor, Ontario, at the age of 94. The last several months were very difficult for him, but all in all he lived long, fully, and admirably. He stood for lasting and noble human values. He cared about human beings and the Earth. He believed in justice and freedom and human solidarity and compassion. He had a powerful and permanent effect on us.

Federico Comes Home to Barcelona Compañeros from Detroit Bring the Ashes of a Son of the Spanish Revolution to Rest in Spain

In June and July, during a visit to Spain, my partner Marilynn Rashid and I spread some of the ashes of Federico Arcos, a companero, friend, and mentor to many of us in Detroit and Windsor, Ontario, including those on the Fifth Estate. Fede, as he was called, died in 2015 at the age of 94.

DETROIT—Veterans of the Chicago battle have been approached by the Federal Bureau of Investigation (FBI) in an attempt to get detailed information on Movement activities during the Democratic National Convention.

At least four local residents who were busted in Chicago have since been approached by FBI agents who said “Mr. Hoover wants to get all the facts about this business. he’s very concerned about it.”

Richard Sharvy, an assistant professor of philosophy at Wayne State University, has been indicted by a Federal Grand Jury for refusing induction into the U.S. Armed Forces.

Mr. Sharvy refused induction September 5 of last year after both his student deferment (he was working on a Ph.D. at the time.) and his application for conscientious objector status were denied.

Feds Get Fred

Fred Chase was wearing an “I am Tom Sincavitch” button pinned to his Levi jacket. Fred was waiting for the FBI to take him from his sanctuary at Sacred Heart Church in much the same way that Tom had waited for the same thing almost a year before in St. Joseph’s Episcopal Church.

Fred was supposed to begin trial on May 4 for destroying the draft records of some 34 draft boards in Chicago last May, but was refusing to cooperate with the court system. “I didn’t show up for the trial because I don’t think they have a legitimate right to try me,” he told the Fifth Estate the day he and his supporters and family moved into the church.

Feminist City Club FEN Fatale

In mid-April Detroit women were invited to participate in the opening ceremonies for the new Detroit Feminist Women’s City Club, paid for by the recently-formed Feminist Economic Network (FEN). Festival for People

The most important cultural event in Detroit this Summer will be the Artists’ Workshop’s FESTIVAL OF PEOPLE, or “a summer ecstasy of the contemporary arts.” It will be held on Sunday, August 7, at the Detroit Artists’ Workshop, 4857 John Lodge (corner of Warren), starting at 1:00 p.m. and lasting as long as it has to. Audiences stand in front of a band at a music festival receiving the sound. Some dance; others just absorb. I’ve always been ...one of the dancers. When I began to write and direct theatre, I wanted the audience to be moved, to be allowed to respond in some way other than clapping their hands at the end of a scene. F.E. Weirdo Meets ‘Right-eous’ J.J.

As any kid who plays sandlot baseball will tell you, the kid who owns the ball owns the game. It’s true.

J.J. Scott, of radio station WTAK (“1090 on your AM dial”), is still back there somewhere on that sandlot, and lets no one forget just whose game it really is.

I ran into him a week or two ago rather unexpectedly. I was downtown near Hudson’s selling Fifth Estates when I passed the WTAK trailer in the middle of the Kern block. Just for a goof, I tapped on the soundproof plexiglass front window, smiled my most fetching stoned-hippie type smile, and pointed to the stack of papers I was carrying.

There is a Hebrew idiomatic expression, K’ninah Houra, which Joel Altus explained to me as sort of being equivalent to saying knock on wood after telling of some good fortune you have incurred and you want it not to change.

I certainly should have said aloud K’ninah Houra after writing in our last issue that no harm had come to the Fifth Estate office, Mixed Media bookstore or Plum Street. For no sooner had our issue hit the streets than pellets were shot at the windows of Mixed Media causing total damage. The window was replaced with boards and a sign which read “Holy Smoke, Don’t shoot—It’s Love.” Proprietor Barry Kramer assured us business will continue as usual.

Fifth Estate/Earth First! The Twain Meet in New Mexico

It already seems like a long time ago, but this past June three of us from the Fifth Estate staff headed out by train to New Mexico for our first Earth First! (EF!) Round River Rendezvous (RRR). This was the tenth annual RRR, which EF! describes as its yearly “tribal celebration.”

Needless to say, after the past couple of years of argument, discussion and heated exchange between Fifth Estate writers and people in EF! (see FE’s Fall 1987 through Spring 1989), we undertook the journey with excitement and a bit of trepidation. We were anxious to meet more of the faces behind the words, and though we had received warm invitations from several EF! individuals, we also received a few not so warm challenges to attend, and we weren’t sure we’d be welcomed by all.

Fifth Estate Moves to Warren Forest

The coming of summer has meant a great increase in activity in the Warren Forest area near Wayne State University.

Trans-Love Energies Unlimited, the Detroit hippie cooperative with offices located in the center of The Forest, at John Lodge and Warren, has reorganized its facilities in order to better serve the community and the Fifth Estate has moved its offices to 1107 W. Warren in Warren Forest. A cooperative store and trading post recently opened in the Artists’ Workshop under the direction of Dennis and Janet Smith and Pun the sandal-maker, and, in the biggest move, Trans-Love agents will open a huge concert-house, THE SEE, on the outskirts of The Forest, at 3929 Woodward just south of Alexandrine.

Seventeen years after a lawsuit begun by social activists, including this newspaper, against the Detroit Police Red Squad, the sordid episode of cop spying has almost come to its climax. During its 50-year history of dogging radicals, peeping over transoms, paying informers and keeping the most excruciatingly detailed list of license plate numbers taken from cars at radical gatherings, the gumshoes managed to amass over one million names in their files.

Fifty Years Ago The Origins of Berkeley’s Ohlone Park

Working on what was called, People’s Park Annex, 1969.

Bay Area Rapid Transit (BART), in the late 1960s, demolished 200 Berkeley homes to trench and submerge their rail system. BART then filled in tons of dirt on top of the tube it built and in this way “reclaimed” the land that it bulldozed.

It strip-mined Berkeley to submerge the trains and above left four blocks along Hearst Avenue a barren, ugly field of dust in summer and mud in winter. An eyesore. BART officials said that they didn’t have funds (or mental bandwidth?) to develop it, that is, monetize it.
